Prenuptial and Postnuptial Agreements

If you have assets that you have acquired that you wish to keep as your separate property once you are married, you need an experienced divorce lawyer who is familiar with the law of pre-nuptial agreements and experienced in drafting such agreements in contemplation of marriage.
Pre and post nuptial agreements are written contracts made between people in contemplation of marriage (pre-nuptial) and between married couples (post-nuptial). Some people may find such an agreement contrary to the idea of marriage. However, when done correctly, negotiating and preparing a pre-nuptial agreement is not an uncomfortable process.
These written agreements are designed and drafted to clearly delineate the terms by which all marital and all separate property shall be defined. In the event of a divorce, these agreements are designed to be the plan of distribution of the marital estate.
Some people believe that a pre-nuptial agreement is not the way to start a marriage. Actually, if the parties both agree, the pre-nuptial agreement process can serve as the catalyst to an important and informative discussion to ascertain the parties financial wishes and desires in their respective property interests.
The parties should each have their own individual attorneys when entering into a pre or post-nuptial agreement.
