Nassau County and Manhattan Uncontested Divorce Lawyer

About Uncontested Divorce:

When both parties agree to get an uncontested divorce, they have already agreed to settle all of their issues - custodial and financial - and agree that they will cooperate with the divorce process and will both sign all of the requisite documents for submission to the Court.

In order to be divorced in New York State, there must exist one of seven "grounds" - the legal reason the court should grant the parties a divorce. A new law was enacted in New York and went into effect on October 15, 2010, which adds an additional ground - "The relationship between husband and the wife has broken down irretrievably for a period of at least six months, provided that one party has so stated under oath." The public is referring to this law as "No fault divorce in New York. However, there is not a consensus among legal scholars and practitioners as to what effect this new law will actually have on the law of divorce in New York. 

The law of divorce in New York State has recently changed and has yet to be litigated in court and presented to judges for their interpretation. This complicated and at times confusing legal structure requires an experienced lawyer, counsellor and advocate.
